You should do one on a tiktok where I saw another instance of power hungry tyranny on a divided scenario. The Officer in question used his forceful power to arrest and detain a HOMEOWNER JUST FOR FILMING ON HIS PROPERTY. Just simply for filming the officer in question and this officer is still active.
Though, would not the implied intent, within the video, be an arguable defense of fifth? It's baffling , if " Justice " is so "Red taped." (THAT, Not ´If,´) Remember, this was a "speeding ticket stop" Which should have gone, "information ( Reason for stop) "No, we can hear eachother. Write a ticket, thank-you. Any other argument by a Leo is over legal power. (which sadly (Gladly) You find the fault)

I'm the cop, you're the violator? Does innocent until proven guilty not apply in the USA? If you didn't open the window fully in the UK they'd have a good sniff for weed and booze and let it go... probably. I always cooperate though, I have a good record on computer, including assisting the police and it can do great things for me, I ended up with a medical do not stop marker after treating a red light as a give way and speeding, unknown for an ordinary citizen transporting blood.

The citizen seemed like he wanted to piss off the police officer as much as possible. We don't know if he was speeding because he refused to cooperate with the police officer. If you didn't do anything wrong then answering the questions won't incriminate you.
In the original video he started driving and he passed the speed limit by 1 mile. That would be fine by itself but it was quickly increasing before he cut the camera. I think anyone who immediately goes over the speed limit after being caught for speeding is guilty.

Hey y'all armchair lawyers - according to the US Supreme Court, yes he can order him to roll them down. He can also order him to exit the vehicle. He can even order passengers out. And yes, he could use force if necessary to make him comply. It's about the cops safety. He could even arrest the driver - without the cop giving any reason. He'd have to be told why - but there's no law saying it must be at the scene, and the cop only needs to justify it to the court, not a street lawyer. The cop was being polite to a complete jerk.

Alright, I know this might get me some hate, but here goes. This is just my speculation, but I think the cop wanted his window down all the way so that he could see his hands/ lap/ lower body in general. After all, this guy has pretty tinted windows, so it would have been hard to see through them from the outside. In addition, this guy doesn’t keep his hands on the steering wheel. When the cop walks up, they are both in his lap out of his view. Throughout the video, he will alternate between putting one of his hands up on the steering wheel while keeping one down, to sometimes putting both down again. I’m not necessarily saying the cop was right. It seemed like his behavior was questionable, in that it seemed like he was trying to get him to confess to speeding, and he could have perhaps calmly told the guy straight off to keep his hands on the steering wheel and open his window all the way when all of this started. I’m just saying, some aspects of his behavior seemed quite understandable.
Whether it seems like it or not there is a mutual respect between the two of them. Interesting encounter to watch

I got pulled over in Gardnerville, NV in 1988. It was just after dark and I was coming into town from CA in my Ford F-150. The speed limit steps down from 55 to 25 over about 1/2 mile. I was obeying all regulations and my lights and turn signals were in perfect condition. Apparently the local sheriff was having deputies stop people at random. An officer followed me into the traffic stop and turned on his lights. I pulled over as requested and rolled down my window. The officer approached my window and I asked him why he pulled me over. He stated that I was weaving in my lane. A lie. I responded that I was not weaving in my lane. I gave them the license, and registration they requested. Several officers at the stop then began to ask me questions about my cargo of furniture and belongings. I asked them what has the contents of my truck have to do with the traffic stop. No answer from them. They then asked me where I was going, I responded what that had to do with the traffic stop, no answer from them. I began to become somewhat frustrated and told them that they were harassing citizens for no reason and that I wanted to speak with their watch commander. I was released shortly thereafter without any citation for weaving in my lane. I hope I was able to educate some of the trainees at the traffic stop that evening.
But beyond all that... how fast really?

This driver is an idiot. Yes, he’s legally in the right. But he is doing so in a way that will cause unnecessary escalation between them. Fact is, there is unnecessary risk to both parties caused by the officer being asked to enforce traffic violations. Every part of the interaction is used by the officer to asses threat. The driver is causing unnecessary perceived threat. It’s kind of like a motorcyclist who refuses to yield because he has right away. You might be right, but you’re still dead 🤷♂️

Well simple fact regarding rolling the windoqs all the way down is for the officers safety. If we do go deeper to laws or if we rely on the books i have no idea i am not a lawyer but for officers safety i think it is fair to be transparent becuase many officers loose their lives as well as civilians. Mr. Transparency i guess is not very transparent. Just saying.

I am a law enforcement supporter, however law enforcement should not be putting citizens in compromising situations. If it were a woman, should probably should be careful rolling her window down for her safety. It has also been known that cops have reached into cars without self control and inflicted harm on a citizen. Those who possess power should not be used as a control tool. The man was clearly exercising his right by a which should be respected by the officer. Each officer has to keep an oath to not over reach their power.

The "lawful" order was "my lights are on and I want you to pull over"".. You pull over and obeyed the "lawful" order. After that is just cooperation. They're able to communicate fine, it's not a "lawful order" to use "unbridled power" because the officer wants to "bust balls".about how far a window is open. That's how I see the statue as far as following a "lawful order". If a driver refuses to give a DL & insurance, then that's refusing a "lawful order". Lawful Orders are only things that pertain to required laws. A level of a window is not a law, having a valid license & Ins. Is.

im a clear defender of ones rights and safety in traffic stops and glad that this guy had a dashcam to keep the officer in check and by no means excuse the actions of the officer in question. with that said, i really want to know what safety measures having a window partially cracked would have from a direct risk assessment aspect, since we’re in this weird junction between law and human conscience (e.g the law doesn’t explicitly state a majority ruling on the measures of being told to roll the windows down and the obvious feelings of both the officer wanting to have clear space between the individual and individual wanting a barrier between them) because i really do hate to say it, but this quickly became from the start a dick-measuring contest when a more straightforward approach of either the officer ignoring the window or the driver just rolling it down would have been the real risk-management technique to use here like seriously, was the window in either party’s case going to inhibit either of there goals? while i also do applaud the driver’s knowledge of the information of what he does and does not disclose, i only wonder if it would have been better to switch on the “demonstration of rights mode” once his rights were actually near being ignored and passed over by the officer? all that said, it’s always a tricky situation when u look into matters like this and by no means do i want to posit that my supposed solutions would’ve been the most absolute best course, but i worry that “easily preventable” situations like this don’t impeded audits of less clear and more impactful traffic stops and other police encounters in the future...
